REGULATED DRUGS-LAW ENFORCEMENT

An Act amending 63 O.S.1961, § 466, § 467, and § 468; trans-
ferring the Division of Regulated Drug Enforcement from
the office of the Attorney General to the State Bureau of
Investigation; and declaring an emergency.
Be it enacted by the People of the State of Oklahoma:
Section 1. 63 O.S.1961, § 466, is hereby amended to read as fol-
lows:
§ 466. "Regulated drugs" defined-Special instructions-Instruction
of law enforcement personnel
(a) The words "regulated drugs" as used in this Act, shall mean and
include the following drugs, all as defined by the laws of this State:
(1) Narcotic Drugs.
(2) Marihuana (Cannabis Sativa, Cannabis Indica, or any drug or
preparation made from any species or variety of the botanical genus Can-
nabis or any compound, derivative, or preparation thereof).
(b) The Director of the State Bureau of Investigation, through the
Chief of the Division of Regulated Drug Enforcement, (1) shall compile
and make available to all law enforcement officers in this State, including
Sheriffs and City Police, special instructions designed to assist such of-
ficers in the detection and control of the improper use of regulated drugs
and in the enforcement of laws relating to regulated drugs; (2) when
requested by any law enforcement officer in this State, shall furnish per-
sonnel to meet and advise with and instruct such law enforcement officer
or officers with respect to the detection and control of the improper use
of regulated drugs and the enforcement of laws relating to regulated
drugs.
Section 2. 63 O.S.1961, § 467, Is hereby amended to read as follows:
§ 467. Division of Regulated Drug Enforcement in office of Direc-
tor of State Bureau of Investigation
For a stricter enforcement of the laws of the State of Oklahoma regu-
lating and controlling the prescribing, sale, giving away, administering,
furnishing, dispensing, and possession of regulated drugs, the Director
of the State Bureau of Investigation shall establish in his office a Division
of Regulated Drug Enforcement, and he shall have authority to employ
a Chief of the Division of Regulated Drug Enforcement. The Chief shall
be a graduate of a recognized school of narcotics, or have a minimum of
ten (10) years experience in narcotic enforcement. The Director of the
State Bureau of Investigation shall have the authority to appoint and
fix the compensation and duties of not to exceed two (2) enforcement
agents, and one (1) stenographer to enforce said laws, to administer said
Division, and otherwise carry out the provisions of this Act. The Chief
and enforcement agents so appointed shall have the powers of peace
officers and the Attorney General shall have concurrent authority with
the County Attorneys to institute and prosecute said laws pertaining to
regulated drugs.
Section 3. 63 O.S.1961, § 468, is hereby amended to read as follows:
§ 468. Rules and regulations
The Director of the State Bureau of Investigation is hereby authorized
and directed to adopt and enforce such rules and regulations as he may
deem necessary to carry out the provisions of this Act.
