HOUSE BILL NO. 788
AN ACT permitting incorporated cities and towns of states adjoining the State of Oklahoma, in the cir-
cumstances prescribed herein, and for purposes limited hereby, to acquire, by purchase, from corpor-
ations owning the same on the effective date hereof, title to, or any lesser interest in, lands within the
State of Oklahoma, and to hold the same so long as used for such purposes; and declaring an emer-
gency.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
Section 1. Authority of Cities or Towns in Adjoining State to Acquire
Lands or Water Rights Within Oklahoma Under Certain Conditions. Where
a private corporation which furnishes water to water users in an incorporated
city or town of a state adjoining the State of Oklahoma, or to such a city or
town for resale to water users therein, owns, on the effective date of this
Act, the title to, or any lesser interest in, lands within the State of Oklahoma
upon which is located, in whole or in part, a reservoir from which such
water or a portion thereof, is obtained, which reservoir has been in existence
on such lands for more than one (1) year prior to the effective date of this
Act, and which land, or interest therein, has been owned by such corporation
for more than fifteen (15) years prior to the effective date of this Act, such
incorporated city or town is hereby granted permission, if authorized or em-
powered by the laws of such adjoining state to do so, to acquire, by purchase.
from such corporation, its title to, or lesser interest in, any such lands within
the State of Oklahoma, together with any easements or rights-of-way then
owned by such corporation over and across other lands within the State of
Oklahoma, necessary for pipe lines to convey water from such reservoir to
a point or points outside the State of Oklahoma, for use in connection with,
but only for use in connection with, the establishment, betterment or expan-
sion of a municipally-owned water supply or system, and the necessary pro-
tection of such water supply from pollution, and the maintenance and oper-
ation of such muncipally-owned water supply or system, and may continue
to hold lands, easements and rights-of-way so acquired as long as the same
are so used.
