HOUSE BILL NO. 627.
AN ACT amending Title 2, Oklahoma Statutes 1951, Section 602.5; providing that a cash bond may be
filed in lieu of a surety bond by aerial applicators of insecticides, herbicides and fungicides; and de-
claring an emergency.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
Section 1. Permit Fees-Expiration of Permit-Surety or Cash Bond.
Title 2, Oklahoma Statutes 1951, Section 602.5 is hereby amended as follows:
Section 602.5. No permit shall be issued under the provisions of this
Act until the applicant therefor has paid a permit fee to the State Board of
Agriculture in the amount of Twenty-five ($25.00) Dollars for aerial appli-
cators, and the amount of Five ($5.00) Dollars for all other applicators, which
shall be deposited in the Department of Agriculture Trust Fund, and each
permit shall expire at the end of the calendar year in which it is issued; and
no permit shall be issued until the applicant has executed and filed with the
State Board of Agriculture a corporate surely bond guaranteeing that the

applicant will answer in damages to any person injured by failure of the appli-
cant to comply with the rules and regulations of the State Board of Agriculture
governing the use and application of insecticides, herbicides and fungicides;
provided, however, that aggregate liability of the surety to all persons so
damaged shall, in no event, exceed the sum of twice the amount of said bond.
Such bond shall be required and may be in an amount fixed by the rules and
regulations of the State Board of Agriculture provided that applicants may
file a cash bond in lieu of said corporate surety bond if said applicant so desires.
