HOUSE BILL NO. 621.
AN ACT relating to fire departments; fixing rates of payment of pensions to widows and children of
deceased firemen, which firemen at time of death were drawing pensions; amending Section 368 and/or
368a of Title 11, Oklahoma Statutes 1951, and declaring an emergency.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
Section 1. Pensions of Widows and Children. Section 368a of Title 11,
Oklahoma Statutes 1951, is hereby amended to read as follows:
Section 368a. In the event of the death for any cause of a fireman who at
the time of his death was drawing a pension, the widow of such person shall
be paid an amount not to exceed One Hundred (100%) per cent of said pension.
In the event of the death or marriage of the widow her . pension shall cease,
and should there then be but one living child same shall receive an amount
equal to Forty (40%) per cent of the pension, but if there then be more than
one living child, each child shall receive an amount equal to Twenty-five
(25%) per cent of the pension. The pension of each child shall continue until
same shall have married or attained the age of Eighteen (18) years. Provided,
that in the event the Board finds that such a child who has not married and
who at the time it reaches the age of Eighteen (18) years is either physically
or mentally disabled, the pension thereof shall continue so long as such dis-
ability remains; Provided, further, that in order for a widow to qualify for
said pension she must have been married to and living with the pensioner as
his wife at the time of his retirement and at least five (5) continuous years
prior thereto; Provided further that widows and children now receiving pensions
under the provisions of Sections 368 and/or 368a, Title 11, Oklahoma Statutes
1951, shall, upon application to the Board, thereafter be entitled to a pension
equal to the amount which they would have received if this Act were in
effect at the time the right to said pension accrued.
