ACTS OF THE TWELFTH LEGISLATURE
Highway Commission.
AN ACT repealing Chapter 71, of the Session Laws of 1927, and creating a Highway Com-
mission; providing for the appointment and procedure of removal of said commission;
providing for tenure of office, salaries and expenses of such commission; and declaring
an emergency.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAK'OMA:
Highway Commission-Members.
Section 1. A State Highway Commission is hereby created, with
offices at the state capitol, and said offices shall be furnished and
provided for by the State Board of Public Affairs. That State
Highway Commission created by this Act shall consist of three
members, not more than two of whom shall be of same political
party. Said commission shall be appointed by the Governor by
and with the advice and consent of the Senate; one member shall
be appointed for a term of two (2) years; one member shall be
appointed for a term of four (4) years; and one member shall be
appointed for a term of six (6) years. And upon expiration of the
terms of office of said commissioners, respectively, their successors
shall be appointed by the Governor by and with the advice and con-
sent of the 'Senate for a term of six (6) years.
Any commissioner appointed under the provisions of this Act
shall hold office for the term for which the appointment is made.
Provided, that any such commissioner may be removed from office
only by any court of competent jurisdiction for wilful neglect of
duty, corruption in office, drunkenness, incompetency, or any offense
involving moral turpitude committed while in office.
Governor-Vacancies-Appointments.
Section 2. The Governor shall have the authority to fill tem-
porarily by appointment all vacancies that may occur in said com-
mission, and when said appointments arp confirmed by the Senate
said appointees shall hold office until the expiration of the term
for which they were appointed. The Governot shall present to the
Senate for confirmation, immediately upon the convening of said
body, either in special or regular session, all appointments made
by him to fill vacancies that may have occured (sic), whether by res-
ignation, death, removal or expiration of term since the adjourn-
ment of the preceding Legislature. Upon the failure of the Senate to
confirm any appointment to said commission, after being presented
to it, no person so appointed shall receive any pay for services ren-
dered after the Senate has refused to confirm and approve said
appointment.
Salary-Actual And Necessary Expenses.
Section 3. Each of said commissioners shall be paid a salary of
six thousand dollars ($6,000.00) per year, payable in equal monthly
installments and be allowed their actual and necessary expenses
incurred in the performance of official duty.
Repealing Clause.
Section 4. Chapter 71 of the Session Laws of Oklahoma, 1927,

and all Acts and parts of Acts in conflict herewith are hereby re-
pealed.
Emergency.
Section 5. It being immediately necessary for the preservation
of the public peace, health and safety, an emergency is hereby de-
clared to exist, by reason whereof this Act shall take effect and be in
full force from and after its passage and approval.

CHAPTER 69.
SENATE JOINT RESOLUTION NO. 18.
Authorizing Institution For Feeble Minded, Enid, Oklahoma to
Purchase Land.
A JOINT RESOLUTION authorizing the Oklahoma State Institution for Feeble Minded at
Enid and the State Board of Affairs to purchase an adlitional twenty-one acres of
land, and declaring an emergiency.
WHEREAS, the Oklahoma State Institution for Feeble Minded,
located at Enid, has found it necessary to lease twenty-one (21)
acres of land adjoining the institution, in order to protect the
sewerage outlet from the institution; and
WHEREAS, the purchase of this land is necessary to the e!-
ficient operation of the institution:
NOW, THEREFORE, BE IT RESOLVED BY THE SENATE
AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF
OKLAHOMA:
Board of Affairs-Purchase Land.
Section 1. That the State Board of Affairs and the Institution
tor Feeble Minded at Enid, Oklahoma, are authorized and em-
powered to purchase twenty-one (21) acres of land, now leased to
the Institution for Feeble Minded, and to pay for same the sum
of Thirty-one Hundred and Fifty ($3150.00) Dollars, the purchase
price of this twenty-one acres of land. Said sum of Thirty-one
Hundred and Fifty ($3150.00) Dollars shall be paid from the Re-
volving Fund of the Institution for Feeble Minded.
Emergency.
Section 2. It being immediately necessary for the public
peace, health and safety, an emergency is hereby declared to exist,
by reason whereof this Act shall take effect and be in full force
from and after its passage and approval.
